 This website is owned and operated by Actor to Artist, a California Company. Our mailing address is 2046 Hillhurst Ave. #113, Los Angeles, CA, 90027.

You must be at least 18 years of age to access or use Our website, products, services, programs, coaching, packages, masterclasses, challenges, social media, and both in-person and online experiences. Children under the age of 18 are prohibited from using the website. Use of this website is at Your own risk. We host Our site on a reputable platform and take reasonable efforts to maintain and host the site. However, We make no explicit representations or warranties as to the safety of Your individual use of the website. The Terms and Conditions contained on this page are subject to change at any time.

 TERMS​ ​OF​ ​SITE & COURSE ACCESS AND​ PRODUCT​ ​PURCHASER​ ​AGREEMENT

 All programs, products, social media, podcasts (The Actor’s Wish), masterclasses, workshops, challenges, coaching packages, coaching sessions, Reiki Distance Healing sessions, Emotional Freedom Techniques (EFT/Tapping) sessions, Breathwork sessions and services are owned and provided by Actor to Artist (“Company” or “We” or “Us” or “Our”). The term “You” or “Your” or “Client” refers to any user or purchaser of said online program(s), product(s) and digital product(s), online masterclass(es), online course(s), online membership(s), online workshop(s), online challenge(s), coaching package(s), coaching session(s), Reiki Distance Healing Session(s), EFT/Tapping 1:1 sessions or packages, EFT/Tapping group session(s) (online or in-person) or service(s), Breathwork 1:1 sessions or packages, Breathwork group session(s) (online or in-person) or service(s) (the “Offering”). The terms “site” or “website” refers to actortoartist.com. These Terms and Conditions of Use govern and define how You are allowed to use and access Company’s Offering. We reserve the right to update and change these Terms and Conditions of Use at any time, and will update them accordingly with the ‘date last updated’ at the top of this page. 

 You are legally bound to these Terms and Conditions of Use whether or not You have read them. If You do not agree with any of Our Terms and Conditions of Use, please email Us at impulse@actortoartist.com and We will make reasonable efforts to remove Your name, email, and access to Our Offering and website(s).

 When You purchased Our Offering, You were given a reasonable notice that these Terms and Conditions of Use existed. By moving forward with Your purchase of the Offering and further access of the Offering, You implicitly agreed and continue to agree to abide by these Terms and Conditions of Use, as well as any disclaimers and privacy disclosures contained in these Terms and Conditions of Use.

ONLINE COURSE INTELLECTUAL PROPERTY

 Any and all materials, paid or free, that You access on this or any related domains, such as The Actor’s Wish Podcast, that contain Our Offering are under the sole ownership or licensed use of Actor to Artist.

 To be clear, We own Our page layout and design, overall look and appearance, individual graphics, icons, videos, The Actor’s Wish Podcast, logos, taglines, and trademarks (common law or federally registered). You are not allowed to reproduce any part of Our website(s), program(s), product(s), service materials, or related communications.

 You are only receiving a limited, non-transferable, non-exclusive, revocable license for non-commercial use only in order to access any content or materials in the Offering You have paid for or opted to receive. If You exceed the scope of this license, as determined by a legal authority such as a court of law or the Trademark Trials and Appeals Board, You have committed infringement in a manner that materially harms Us, and We have the right to seek damages and/or an injunction to remedy the situation until We are made whole.

●      Use Our trademarks and copyrighted materials with Our consent and proper credit and marking, namely, citing © Actor to Artist as the source of the materials and marking any federally registered trademarks with ® or common law trademarks with ™.

●      Re-sell or trade Your access to the Offering.

●      Share the Offering with anyone else who has not yet purchased it or opted in to receive it. 

●      Reprint or republish any of the Offering, in part or in whole.

●      Distribute any of the materials contained in the Offering or related materials and/or communications as Your own, otherwise known as stealing.

●      Reproduce and tweak any part or whole of the Offering for distribution as Your own work.

●      Claim ownership or use over any of Our intellectual property without Our prior consent, which includes (but is not limited to): copyrights such as course materials, worksheets, workbooks, lessons, videos, and more; trademarks such as names, logos, taglines, or other unique source identifiers; or trade dress including the look and feel of the Offering (and its related communications and materials).

 Company reserves the right to refuse service to any order, person or entity without obligation to assign reason for doing so. Company reserves the right to limit any number of participants in any given online class, challenge, masterclass, workshop, coaching package, service or Offering provided. Company may at any time change or discontinue any aspect or feature of the website or Offering.

SECURITY​ ​AND​ ​ASSUMPTION​ ​OF​ ​RISK 

 SECURITY

​It is Your responsibility to secure Your username and password from theft or any other means of unauthorized use that would violate these Terms and Conditions of Use. We do not store any whole credit card numbers or payment information, and instead, these are processed through third-party processors such as Stripe, or Paypal. By utilizing these payment processors to gain access to the Offering, You indemnify Us and instead assume any and all risk or liability for the security of the payment details, and agree to be bound by the third-party payment processor’s applicable terms and conditions of use.

 CONFIDENTIALITY

 You have no right to confidentiality unless otherwise explicitly stated, such as in a subsequent client agreement, or otherwise implicitly agreed upon as mandated by law or fiduciary duty. 

 ASSUMPTION​ ​OF​ ​RISK

 ​By accessing Our Offering and/or related materials, whether paid or unpaid, You assume all the risk of Your access and any subsequent actions You choose to take as a result of the influence, information, or educational materials provided to You.

EMOTIONAL FREEDOM TECHNIQUES (EFT)/TAPPING DISCLAIMER

Emotional Freedom Techniques (EFT) is a self-help method designed to release and resolve physical and emotional distress by clearing blocks within the body’s energy system. It draws from acupuncture, cognitive reframing, exposure therapy and other time honored systems of healing. Gentle stimulation of acupressure points by tapping while focusing on emotional issues is believed to activate the Relaxation Response, thus returning the body to a state of balance. While there are theories as to how EFT works, why it works and why it sometimes does not work, there is no accepted scientific explanation.

EFT is gentle and easy to use. To date it has yielded remarkable results for relieving emotional and physical distress. While so far there have not been any reports of distressing side effects when EFT is administered by a qualified practitioner, it does not mean that you will not discover side effects for yourself.

While EFT is a technique which has produced remarkable clinical results and is gaining in scientific support, it is not yet widely accepted as a formally validated scientific technique and thus must be considered to be in the experimental stage with no guaranteed outcome in any individual.

EFT is not used to diagnose, treat, cure, or prevent any physical or psychological illness or mental health disorder. Consequently, EFT sessions do not provide medical diagnoses nor do they offer cures. EFT is considered a complementary or adjunct treatment option; therefore, it does not replace health care from medical professionals.
This technique may bring to the surface other issues that need addressing, perhaps ones you were not aware of. If and when this happens, you agree to inform your practitioner as soon as is reasonable. Be advised that your consent to use these techniques involves your voluntary agreement to take full responsibility for your well-being and behavior and to indemnify your practitioner.

BREATHWORK DISCLAIMER

Breathwork can result in physiological changes in the body and/or intense physical and emotional release.

Medical Conditions

Participant certifies that they:

● Are not pregnant

● Do not have epilepsy, a detached retina, glaucoma, uncontrolled high blood pressure, cardiovascular disease or irregularities, including but not limited to prior heart attack or arrhythmia

● Have not been diagnosed with bipolar disorder or schizophrenia

● Have not had a stroke, TIA, seizure, or other brain/neurological condition

● Do not have a family history of aneurysms

● Are not using prescription blood thinners such as Coumadin

● Have not been hospitalized for a psychiatric condition or emotional crisis in the last fifteen years

● Do not have osteoporosis severe enough to cause injury from intense

movement

● Do not have uncontrolled thyroid conditions, diabetes or asthma

● Do not have any recent physical injuries that could be re-injured

● Do not have any other medical or physical conditions that would impair or affect their ability to engage in breathwork safely

If diagnosed with PTSD and currently in therapy, Participant is encouraged to obtain approval from their therapist before participating. If Participant has asthma, they must have their inhaler accessible during sessions. If there are any doubts about participation, consultation with a physician or therapist is required before attending

Physical, Mental, and Emotional Effects

Participant understands that breathwork may involve physically, emotionally, and mentally challenging experiences. This may include, but is not limited to:

● Deep and rapid breathing, which can cause dizziness, palpitations, tingling/numbness, muscle spasms, ringing in the ears, perceptual distortions, and feelings of euphoria

● Intense physical movement and exertion beyond normal activity levels

● Exposure to loud music and emotional or psychological shifts

Personal Responsibility

Participant agrees to follow the stated guidelines and norms of breathwork sessions. If experiencing unusual physical symptoms or hazards, the Participant will immediately stop participation and inform the Organizer or Facilitator. Participant acknowledges that they:

● Have been informed of the nature of the activities and potential challenges

● Are responsible for monitoring their comfort level and can stop at any time

● Assume all inherent risks in breathwork activities

● Acknowledge that in-person (and online) sessions require mindful participation for best results

● Understand that the Organizer is not responsible for lost, stolen, or damaged personal property (in-person sessions)

Medical Responsibility

Participant understands that breathwork is a personal growth practice and is not a substitute for medical or psychological treatment. Participant acknowledges that:

● Breathwork Facilitators are not healthcare professionals and do not diagnose or treat medical or psychological conditions

● Breathwork sessions may trigger suppressed trauma

● They are responsible for their physical, emotional, and mental well-being

● They release the Organizer and any associated Facilitators from any liability for personal injury or psychological distress that may arise from participation

● They will inform the Organizer of any changes in medical condition before

participating in future sessions

Confidentiality

Participant agrees to maintain confidentiality regarding comments, shares, or experiences of other participants. Participant also agrees to:

● Refrain from audio or video recording of sessions

● Not take photos or videos of others without their explicit verbal consent

● Understand that their participation may be terminated at the discretion of the Organizer without explanation.

Limitation of Liability

Participant acknowledges that:

● They absolve the Organizer and associated parties of any liability related to breathwork participation

● They release all claims for direct, indirect, incidental, or consequential damages resulting from participation in sessions, whether in-person or online

● If dissatisfied with any aspect of the breathwork sessions, their sole remedy is to discontinue participation

Agreement Acceptance

Participant has read and understands this Agreement, including the release of all claims. Be advised that your consent to use these modalities involves your voluntary agreement to take full responsibility for your well-being and behavior and to indemnify your practitioner.

In order for you to be a Breathwork client, you accept this these Terms and Conditions of Use.

TESTIMONIAL DISCLAIMER

The testimonials, statements, and opinions presented on Our website or Our social media are applicable to the individuals who wrote it. Results vary and may not be representative of the experience of others. The testimonials are voluntarily provided and are not paid, nor were they provided with free products or services, or any benefits in exchange for their statements. The testimonials are representative of Client experiences but the exact results will be unique and individual to each Client.

 ​You acknowledge and agree that We are not liable for any defamatory, offensive, or illegal conduct of any other participant or user, including You.

FINANCIAL​ ​CONSIDERATIONS 

 REFUNDS

We take Your investment seriously, and We’d appreciate if You took Our investment of time and resources into Your success seriously, too. 

We have a strict No Refund Policy to keep the integrity of the business.

 All digital product sales are final due to the nature of downloadable files and Your irrevocable access to them once they’ve been delivered. If You are on the fence about whether or not something would be a good fit for you, email us to impulse@actortoartist.com anytime and ask all the questions You would like to make sure You + Actor to Artist = dream team. 

SUBSCRIPTION REFUNDS

Subscriptions created will not automatically cancel. If You would like to cancel a monthly subscription, You may do so at any time, just send over an email request to impulse@actortoartist.com. In order to not get billed for the following month, You must cancel before the 11th of this month. Once cancelled, You will no longer be charged going forward. Payments for the next billing cycle will not be refunded, so make sure to cancel prior to the 11th of the month. No refunds for past months will be given. 

COACHING REFUNDS

There are absolutely no refunds on coaching, Reiki Distance Healing, Breathwork or EFT Tapping session/package (1:1 or group experience) once the services are rendered. We cannot guarantee results in a coaching or consulting relationship, because results depend on Your openness to being coached and Your willingness to do the work.

There are absolutely no refunds on individual or group EFT Tapping, Breathwork or Reiki Distance Healing sessions or packages (series of sessions). An EFT Tapping, Breathwork or Reiki Distance Healing session or package is an experience. For the client to be fully supported in their evolution, full commitment is required for the emotional journey; what a client deems unpleasant at the end of one session can be deemed transformational a week later. Client must be fully committed to the spectrum of emotional processes of the EFT Tapping, Breathwork or Reiki Distance Healing session or package so as to best optimize their experience and transformation. 

CANCELLATIONS AND RESCHEDULING POLICY

Coaching call cancellations may be possible when You, under a Coaching Agreement, notify Company (24) hours in advance of the scheduled calls/sessions. A session may not be scheduled more than twice. Company reserves the right to bill You for a missed meeting. If You did not show up to a scheduled call and did not notify Company in writing via email to impulse@actortoartist.com, the session is deemed rendered and there will be no refunds available for such session. Our time is valuable! Company will attempt in good faith to reschedule missed meetings that were canceled or rescheduled 24 hours in advance. 

If You are late for your scheduled session, it will shorten Your time and Company is not obligated to make up the time.

 PROGRAM AND COURSE PURCHASE REFUNDS

Due to the nature of EFT/Tapping, Breathwork, Reiki Distance Healing and the artistic, emotional or creative process, courses or coaching programs, there are no refunds offered for bespoke programs.

For coaching programs, courses and Offering(s), You will agree to compensate Company for all Coaching Services rendered through and including the effective date of termination of the coaching relationship. If Company were to terminate the agreement, Company agrees to reimburse You for the remainder of the sessions not rendered. These are the only refunds available for coaching programs, courses and Offering(s). 

You agree to pay for all installments of payment plans as agreed upon by the request and acceptance of the Offering and are irrevocably bound to complete such payments. Company shall not be liable for issues You may have personally or financially in regards to payments in full and payment plans, and shall hold You accountable for such payments for services rendered, even when You missed sessions whether notified or not. 

Under no circumstances are refunds offered after the cut-off date. After that date, You are responsible for making all the payments in full. We’re sure you’re getting massive value and results from doing the work!

CHARGEBACKS

 ​​You agree to make every attempt to file a refund prior to attempting a chargeback with Your financial institution. In the event of a chargeback attempt, You expressly agree to forfeit any and all of Our bonuses, affiliate bonuses, or other materials afforded to You in exchange for Your original purchase of Our Offering. We reserve the right to present proof of Your access and these Terms and Conditions of Use to the financial institution investigating the dispute. 

 RECURRING​ ​PAYMENTS

 ​If You have signed up for a payment plan, You hereby authorize Our continued access to Your financial information stored by Our third-party financial processing company referenced in this Agreement until Your payment plan is complete, as set forth in Your acceptance of the purchase terms upon checkout. 

REVOCATION​ ​OF​ ​ACCESS

 ​You have the unilateral right to terminate Your use and access to any of Our Offering(s). Please send an email to impulse@actortoartist.com to initiate this process. Termination will not excuse You of further payment. Upon confirmation of Your termination, any and all outstanding balances will become immediately due and payable. Any existing balance that remains after 14 days from the date of termination will be sent to a collections agency, and You agree to be responsible for any additional charges, fees, or costs associated with such a collection effort, including but not limited to reasonable attorney’s fees and court costs. 

DISPUTE​ ​RESOLUTION

 ​If You and Our Company cannot find a resolution to a dispute or potential claim by means of good-faith negotiation, then You explicitly agree to make a reasonable attempt to resolve any such dispute through Alternative Dispute Resolution or Mediation before filing a civil cause of action. 

NON-DISPARAGEMENT

​If You are found to be slandering, libeling, or otherwise disparaging Our Company, Offering(s), or related materials at Our discretion, You will be immediately removed from the Offering(s) and any related communications. We reserve the right to file a civil claim of action against You for any such damaging actions You take that materially harm Our Company.

ENTIRE AGREEMENT

 Before You register with Our website or make any purchases therefrom, You will be asked to consent to Our Privacy Policy. If You have consented, or once You do consent, the terms of the Privacy Policy together with these Terms and Conditions, the information contained herein constitutes the entire agreement between site users and Our company relating to the use of this website.

 LAW AND JURISDICTION

 These Terms and Conditions of Use and Privacy Policy are governed by and construed in accordance with the United Sates (“U.S.”) law. Any dispute arising out of or related to the information contained herein is subject to adjudication in the state of New York, U.S.
